About Boxer ICT

Boxer ICT is a Sydney-based technology company. We provide businesses with a range of IT and communications services, including managed IT support, unified communications, enterprise mobility, Telstra network services, and our own platforms — Boxer Live & Analytics and Boxer Live Markets. 

These terms apply to two things: using our website at boxerict.com.au and engaging us for any of our services where no separate written contract has been signed. 

If you already have a signed agreement with us, that agreement takes priority. These terms only apply where that agreement doesn’t cover something. 


Intellectual property

All content published on this Site — including but not limited to written materials, service descriptions, case studies, graphics, logos, icons, and software — is owned by or licenced to Boxer ICT and is protected under Australian copyright law and applicable international conventions. 

You are granted a limited, non-exclusive, non-transferable licence to access and view Site content for your own personal or internal business evaluation purposes. This licence does not permit you to reproduce, republish, modify, frame, scrape, or commercially exploit any part of this Site without our prior written consent. Any unauthorised use may give rise to a claim for damages and could constitute a criminal offence.
 

Acceptable use

When using this Site, you agree not to: 

  • attempt to gain unauthorised access to any part of the Site, its underlying systems, or any connected networks 
  • introduce malicious code, bots, or automated scraping tools

Boxer ICT endeavours to keep Site content accurate and current; however, we make no warranty that information is complete, free of error, or reflects the most current service offerings. Nothing on this Site constitutes a binding quote or commitment to provide services. Formal service engagements are confirmed only through a signed Statement of Work or Service Agreement.
 

Disclaimer of warranties

To the maximum extent permitted by the Australian Consumer Law and other applicable legislation, this Site and all content on it are provided on an “as is” and “as available” basis. Boxer ICT does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We expressly disclaim all implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement, except where such warranties cannot lawfully be excluded.
 

Limitation of liability

Subject to any statutory rights you hold that cannot be excluded under Australian law, Boxer ICT’s total liability to you arising out of or in connection with your use of this Site is limited to the resupply of the relevant information or, at our election, a refund of any amount paid directly for access to that content. We will not be liable for any indirect, special, incidental, or consequential loss or damage — including loss of data, loss of business opportunity, or loss of revenue — whether or not we were advised of the possibility of such loss. Privacy & data handling

Boxer ICT is committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Any personal information you submit via this Site — such as your name, company, email address, or phone number through an enquiry form — will be used solely to respond to your enquiry or provide the services you have requested. 

We do not sell, rent, or trade personal information to third parties. For full details on how we collect, store, use, and protect your information, please refer to our Privacy Policy.
 

Confidentiality

Where Boxer ICT is engaged to deliver IT services, both parties may disclose information that is proprietary or commercially sensitive. Each party agrees to hold such information in strict confidence, use it only for the purposes of the engagement, and not disclose it to third parties without prior written consent. This obligation survives the conclusion of any service engagement. It does not apply to information that is already publicly available through no fault of either party, independently developed without reference to confidential materials, or required to be disclosed by law or a court of competent jurisdiction.
 

Security incidents

In the event of a confirmed cybersecurity incident affecting client systems or data under Boxer ICT’s management, we will notify affected clients promptly in accordance with our incident response procedures and any applicable mandatory notification obligations under the Privacy Act 1988. Boxer ICT will work collaboratively with affected clients to contain, investigate, and remediate the incident as efficiently as possible.
 

Indemnification

You agree to indemnify and hold harmless Boxer ICT, its directors, employees, contractors, and agents from and against any claims, costs, losses, or liabilities (including reasonable legal costs) arising from: your breach of these Terms; any unlawful or negligent act or omission in connection with your use of the Site; or any misuse of information or materials obtained through this Site.
 

Changes to these terms

Boxer ICT may revise these Terms at any time by publishing an updated version on this page. We recommend checking this page periodically. Material changes will be noted with a revised “Last updated” date at the top. Your continued use of the Site after changes are published constitutes your acceptance of the updated Terms.
 

Governing law & dispute resolution

These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales and, where applicable, the federal courts of Australia. 

If a dispute arises in connection with these Terms or the use of this Site, you agree to contact Boxer ICT in the first instance to seek resolution through good-faith discussion. If the dispute cannot be resolved informally within 20 business days, either party may refer the matter to mediation through a recognised Australian dispute resolution body before commencing legal proceedings, unless urgent injunctive relief is required.
